Indicia Terms of Service

Welcome to Indicia, an OSINT (Open-Source Intelligence) Software-as-a-Service platform available at Indicia.app.

By creating an account or using the service, you agree to the Terms of Service (“Terms”) below. If you do not agree, do not use Indicia.

By accessing or using Indicia, you represent and warrant that you are at least eighteen (18) years of age. Access by minors is strictly prohibited.


1. Acceptable Use

Indicia is designed for lawful open-source intelligence work. You agree to use the platform responsibly and in full compliance with all applicable laws. You are solely responsible for how you use the service


2. Prohibited Activities

To maintain platform security and legal integrity, the following activities are strictly prohibited. Violations will result in immediate account termination and, where required, reporting to the appropriate authorities.

2.1 Reselling Credits

  • You may not resell, transfer, or redistribute Indicia credits or usage quotas without written authorization.

  • Unauthorized resale will result in account termination.

2.2 Cybercrime, Intrusion, or Illegal Conduct

You may not use Indicia to engage in, support, or facilitate:

  • Cyberattacks, hacking, or unauthorized access attempts

  • Surveillance, targeting, or disruption of governments, financial institutions, educational institutions, critical infrastructure, or any protected organizations

  • Any action that violates local, national, or international law

Violations will result in:

  • Immediate termination

  • We will report the incident to law enforcement and provide relevant access logs.

2.3 DDoS, Exploits, or Attempts to Bypass Security

You may not:

  • Launch or attempt to launch DDoS attacks.

  • Probe, exploit, or test vulnerabilities in Indicia.

  • Interfere with platform functionality or security controls.

Violations will result in:

  • Immediate termination.

  • Submission of your IP address, email address, login history, and activity logs to authorities.

2.4 Uploading Illegal Content & Sensitive Data

You may not upload, store, or transmit:

  • Illegal material of any kind;

  • Malware, harmful code, or prohibited data;

  • Non-Public Sensitive Personal Information: You may not use the search tools to input, query, or store sensitive financial information, Social Security Numbers, government ID numbers, or health data of any third party;

Illegal uploads will result in:

  • Immediate permanent termination

  • Mandatory reporting to relevant authorities

While Indicia generally does not monitor user activity in real-time, we reserve the right to employ automated hashing or scanning technologies to detect known illegal content (such as CSAM) prior to transmission to third-party providers. If illegal content is detected, we will permanently terminate the account and report the incident, including user logs and IP addresses, to the National Center for Missing & Exploited Children (NCMEC) or relevant law enforcement agencies.

2.5 Unauthorized Automation

You may not:

  • Use bots, scrapers, automated tools, or scripts to access Indicia

  • Circumvent rate limits or attempt to automate requests

Written permission from Indicia is required for any automation. Violations result in account termination.

2.6 Harassment, Stalking, or Targeted Abuse

You may not use the service to:

  • Maliciously target, harass, stalk, or intimidate individuals.

  • Invade someone’s privacy.

  • Enable abuse, doxxing, or personal harm.

2.7 FCRA & Consumer Reporting Restrictions

Indicia is not a “Consumer Reporting Agency” as defined by the Fair Credit Reporting Act (FCRA) (15 U.S.C. § 1681 et seq.) or similar state laws. You are strictly prohibited from using the Service or any data retrieved from it to determine a consumer’s eligibility for:

  • Credit or insurance for personal, family, or household purposes;

  • Employment, promotion, reassignment, or retention;

  • Housing, tenancy, or rental screening;

  • Government licenses or benefits; or

  • Any other purpose governed by the FCRA.

Such misuse will result in immediate termination.


3. User Content & Licensing

You retain all ownership rights to the text, images, and data (“User Content”) you upload to Indicia. However, by uploading User Content, you grant Indicia a worldwide, non-exclusive, royalty-free, fully paid-up license to host, copy, process, and transmit such Content solely for the purpose of providing the Services to you. Third-party AI providers may only use your Content for model improvement or training if you explicitly opt in at the time of upload. Without this opt-in, your Content will not be used for training under any circumstances.

You represent and warrant that: (i) you own or have the necessary rights and consents to use and authorize Indicia to use the User Content; (ii) you have explicitly obtained all necessary written releases, consents, and waivers from any individuals depicted in the User Content, including specific consent to process biometric data where required by law (e.g., Illinois BIPA, Texas CUBI, or GDPR), OR you represent that your use of the content constitutes a ‘legitimate interest,’ ‘fair use,’ or legally authorized investigation under the laws of your jurisdiction that does not require explicit subject consent; and (iii) your User Content does not violate the intellectual property or privacy rights of any third party.

If you choose to provide input and suggestions regarding problems with or proposed modifications or improvements to the Service (“Feedback”), then you hereby grant Indicia an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to exploit the Feedback in any manner and for any purpose, including to improve the Service and create other products and services.


4. Account Security

You are responsible for maintaining the confidentiality of your login credentials.

If suspicious or unauthorized activity is detected, Indicia may suspend or terminate your account to protect the platform.


5. Monitoring and Logging

To enforce these Terms and maintain platform security, Indicia may collect and store:

  • IP addresses

  • Access logs

  • Email address

  • Login history

  • Activity logs

  • Transaction logs regarding usage

This information may be shared with authorities if these Terms are violated. Transaction and activity logs are retained for the periods specified in our Privacy Policy to resolve disputes, enforce these Terms, and comply with legal obligations.


6. Billing, Payments, and Chargebacks

6.1 Payment Terms

Indicia operates on a credit-based, pay-as-you-go model.

All purchases are final and non-refundable, including but not limited to:

  • Unused credits

  • Accidental purchases

  • Purchases made under misunderstanding

  • Purchases made by third parties with access to your account

Because credits provide immediate access to digital services, all sales are final, except where required by applicable consumer protection laws. However, Indicia reserves the right to issue refunds or account credits at its sole discretion in cases of proven technical errors attributable to our platform. Refund requests for any other reason will be denied.

If you are located in the European Union or United Kingdom, you hereby acknowledge and agree that by purchasing credits, you are requesting the immediate performance of the digital service. You expressly waive your right of withdrawal (cooling-off period) once the credits are delivered to your account.

6.2 Unauthorized Use & Payment Fraud

Any form of payment fraud—including stolen payment methods, unauthorized transactions, false disputes, or attempts to circumvent processors—will result in:

  • Immediate account termination

  • Reporting to relevant authorities or antifraud entities

6.3 Chargebacks

Filing a chargeback for any reason without contacting Indicia support first is considered a violation of these Terms.

If you file a chargeback:

  • Your account will be immediately terminated

  • All remaining credits will be forfeited

  • We will provide the payment processor with all evidence needed to dispute the chargeback (including logs and activity history)

  • Your IP address, email, and payment methods may be blocked from future access

  • Fraudulent disputes may be referred to collections

Chargebacks used to bypass the no-refund policy are treated as payment fraud.

6.4 Collections & Debt Recovery

If a chargeback or dispute results in financial loss to Indicia:

  • We may pursue collection efforts through authorized third-party agencies

  • You may be responsible for the original amount owed plus administrative, processing, and collection fees

  • We may report delinquent accounts to financial or fraud databases where legally permissible

6.5 Termination for Payment Issues

Indicia may permanently terminate or restrict your account for:

  • Chargebacks

  • Fraudulent or unauthorized payments

  • Reversed or disputed transactions

  • Abuse of payment systems

  • Attempts to avoid payment obligations

Termination for payment violations is permanent.


7. Termination

Indicia reserves the right to suspend or terminate your account at any time for:

  • Violations of these Terms

  • Security risks

  • Illegal activity

  • Abuse of the service

Indicia reserves the right to permanently delete accounts that meet specific inactivity criteria. If an account holds a credit balance of zero (0) and has not been accessed or logged into for a continuous period of twelve (12) months, Indicia will initiate the account deletion process. We will send a notification to the email address associated with the account providing a thirty (30) day notice. If the account remains inactive at the conclusion of this thirty (30) day notice period, the account and all associated data will be permanently deleted. However, transaction logs, usage metadata, and other records required for compliance or chargeback defense will be retained in accordance with our Privacy Policy.

Once terminated (excluding terminations due to inactivity), you may not create new accounts without written permission.


8. Changes to These Terms

Indicia may update these Terms at any time. Continued use of the service after changes are published indicates acceptance.


9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. INDICIA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE DATA RETRIEVED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. YOU SPECIFICALLY ACKNOWLEDGE THAT ARTIFICIAL INTELLIGENCE AND LARGE LANGUAGE MODEL TECHNOLOGIES MAY PRODUCE INACCURATE, MISLEADING, OR FALSE RESULTS (‘HALLUCINATIONS’). INDICIA DOES NOT WARRANT THE ACCURACY OF ANY GEOLOCATION, IDENTITY MATCH, OR CONTEXTUAL ANALYSIS PROVIDED BY THE SERVICE. YOU FURTHER ACKNOWLEDGE THAT, IF YOU EXPLICITLY OPT IN, DATA TRANSMITTED TO THIRD-PARTY AI PROVIDERS MAY BE USED FOR MODEL TRAINING AND MAY REAPPEAR IN FUTURE ITERATIONS OF PUBLIC AI MODELS. INDICIA IS NOT LIABLE FOR ANY DATA LEAKAGE RESULTING FROM THIRD-PARTY MODEL TRAINING. FURTHERMORE, INDICIA IS NOT A CONSUMER REPORTING AGENCY. THE DATA PROVIDED IS FOR INFORMATIONAL PURPOSES ONLY AND MUST NOT BE USED FOR FCRA-REGULATED PURPOSES, INCLUDING EMPLOYMENT, CREDIT, OR TENANT SCREENING.


10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, INDICIA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS, ARISING OUT OF YOUR USE OF THE SERVICE. IN NO EVENT SHALL INDICIA’S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO INDICIA IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.


11. Indemnification

You agree to indemnify, defend, and hold harmless Indicia, its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (i) your violation of these Terms; (ii) your misuse of the Service; (iii) any violation of third-party Terms of Service (such as those of LLM, API, or data providers) caused by your specific usage, uploads, or queries; (iv) your violation of any third-party rights, including intellectual property or privacy rights; or (v) your violation of any applicable laws. You further acknowledge that your use of the Service involves transmission of data to third-party AI providers. You agree to indemnify Indicia for any violations of said providers’ Acceptable Use Policies caused by your specific queries or uploads.


12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Virginia, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Fairfax County, Virginia.


13. Dispute Resolution & Mandatory Arbitration

13.1 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Fairfax County, Virginia, before a single arbitrator. The arbitration shall be administered by the American Arbitration Association (AAA) pursuant to its Commercial Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction. You understand that there is no judge or jury in arbitration, and court review of an arbitration award is limited.

13.2 Small Claims Court Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court in Fairfax County, Virginia, if the claim is within that court’s jurisdiction and proceeds on an individual (non-class) basis.

13.3 Class Action Waiver

You and Indicia agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis. Neither you nor Indicia will seek to have any dispute heard as a class action, private attorney general action, or in any other proceedings in which either party acts or proposes to act in a representative capacity.

13.4 Right to Opt-Out

You have the right to opt out of binding arbitration and class action waiver provisions within 30 days of first accepting these Terms. To exercise this right, you must send a written notification to support@indicia.app with the subject line “Arbitration Opt-Out.” If you opt out, the arbitration and class action waiver provisions will not apply, and disputes will be resolved in the state or federal courts of Fairfax County, Virginia.

14. Miscellaneous

14.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

14.2 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Indicia regarding the Service and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.

14.3 Force Majeure

Indicia shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor, or materials, or failures of third-party service providers (including cloud hosting or AI providers).
